The Planning Board addressed two main agenda items. For 2175 Liberty Drive (Niagara Digester), the applicant was directed to consult with the Town Clerk regarding solid waste compliance, obtain professional engineer stamps, and secure a negative declaration from the DEC. For 7334 Townline Road (Bunny Bunch Day Care), the Board reviewed deficiencies in the project plans, including missing contour lines, water line designs, grading and drainage details, and accessibility labeling. The Board moved to establish itself as the SEQR Lead Agency for the daycare project and authorized assistance for the coordinated review process.
The Board reviewed audit results and addressed public concerns regarding recent flooding, drainage maintenance, and local property issues. Key actions included the approval of multiple bill payment vouchers and significant budget transfers across various town funds. The Board enacted a temporary moratorium on battery energy storage system facilities, authorized zoning amendments related to accessory building dimensions, and approved the hiring of a building department clerk. Other authorizations included professional travel for the highway superintendent, an event permit for a local fun run, office window replacements for the recreation department, and updates to fire company rosters.
The Zoning Board of Appeals held a public hearing regarding a variance request for a five-megawatt Battery Energy Storage System (BESS). The discussion involved safety concerns, including thermal runaway, fire propagation, training requirements for local volunteer fire departments, and the impact on neighboring residential areas and the nearby Airbase. The applicant withdrew the setback portion of the variance request. Ultimately, the Board voted to deny the variance request for the five-megawatt system, citing self-created hardship, the substantial nature of the request, and potential adverse impacts on the neighborhood and public safety.
